Legal Issues

  • Freehold Condominiums are secured with a Condominium Certificate of Title. This is recorded at the Philippines Registry of Deeds. Foreigners can own condominiums in the Philippines (but not houses).
  • Philippines has a legal system patterned after the United States. Having said that, it is always best not to involve the legal system.
  • Philippine law requires a developer to refund 50% of the investment in a pre-sale condominium if there have been timely deposits for at least 2 years and the purchaser no longer wants to continue.
  • Developers can delay completion of a project and or there can be delays regarding issuing of titles. You want to purchase from a developer that has a spotless record of completing and turning over units on time.
